General Terms and Conditions (GTC) (as of May 30, 2019)

1. Scope

All deliveries and services via the Shofar Shop Onlineshop are made exclusively on the basis of the following general terms and conditions. Any conflicting contractual conditions of the buyer are ineffective. Amendments or additions to the general terms and conditions require written form.

  1. Prices

2.1. The prices are shown in Swiss francs and include the statutory VAT. The prices stated on the Internet pages apply at the time of order receipt. Shipping costs will be charged extra.

2.2. All offers are subject to change. Shofar-Shop (with commerce) reserves the right to refuse an order at any time.

  1. Withdrawal

3.1. The customer is entitled to revoke his declaration of intent to conclude the contract without giving reasons within 30 days after receipt of the goods in text form (e.g. letter, email) or by returning the goods to our delivery agency. The period begins at the earliest upon receipt of the goods. In order to comply with the withdrawal period, it is sufficient to send the revocation or the goods in good time.

The customer bears the burden of proof for the dispatch of the goods to be returned.

3.2. In the event of an effective revocation, the customer is obliged to return the received goods. If the customer is unable to return the received goods in whole or in part or only in a deteriorated condition, the customer shall reimburse the corresponding impairment in the event of his revocation. If the customer has already paid the purchase price, Shofar-Shop is entitled to deduct the impairment from the repayment amount. In individual cases, the impairment may correspond to the purchase price paid.

3.3. The costs of the return shall be borne by the customer, unless the delivered goods or services do not correspond to the ordered goods or services.

3.4. In return, Shofar-Shop will pay back to the customer a purchase price that may have already been paid in the event of an effective revocation. Until the goods are returned in full, Shofar-Shop makes use of its right of retention.

  1. Privacy

Shofar-Shop stores the order and address data for use in the context of order processing (also by transmission to the used order processing partners or shipping partners), for possible warranty cases and for product recommendations to customers.

  1. Delivery

5.1. Delivery takes place exclusively and within Switzerland. The delivery period is usually – if the goods are available ex stock – within three working days. The delivery period is only a guideline and is non-binding. In the event of non-compliance with a delivery period, the customer may withdraw from the order made after expiry of a grace period of at least 14 days to be announced by him in writing. The customer cannot make any further claims.

5.2. Shofar-Shop is entitled to make partial deliveries. In the case of a partial delivery, only the shipping or transport costs of the first partial delivery will be charged by the customer. Additional shipping or transport costs will not be charged to the customer for partial deliveries.

5.3. Shofar-Shop is entitled to freely determine the means of transport and shipping method.

  1. Payment

6.1. The purchase price is due by advance payment or on account.

6.2. The offsetting of the purchase price claim with counterclaims is excluded.

6.3. The buyer acknowledges that Shofar-Shop may assign the claims due to it from the contractual relationship to third parties. Within the scope of these assignments, buyer data will be passed on to the third party if and to the extent that this is necessary for the execution of the legal transaction on the basis of the assignment.

  1. Rights of defects

7.1. Warranty of defects and liability: Products are replaced free of charge, provided that the defect is reported in writing within 5 working days after receipt of the goods. Liability for all products is excluded for consequential damage, loss or damage resulting from improper treatment.

  1. Final provisions

8.1. To the extent permitted by law, Romanshorn (Switzerland) is the exclusive place of jurisdiction for all disputes arising from the purchase of a product via the Shofar-Shop.ch online shop.

8.2 To the extent permitted, this contract shall be governed exclusively by Swiss law. If Swiss law fails to apply, the UN Sales Law shall be decisive.

8.3. Should individual provisions of these General Terms and Conditions be void or become ineffective, the validity of the remaining provisions shall not be affected. An effective provision close to the meaning and purpose of the original clause shall replace the void or invalid provision(s).

8.4. If the parties deviate from the provisions of these General Terms and Conditions in individual respects, this shall not affect the applicability of the other provisions.
